T-Mobile Owns Magenta?

T-Mobile Magenta

We know that colour is a powerful tool in branding, but can a company own a colour as widespread and ubiquitous as Magenta? According to Deutsche Telekom (DT), the owners of T-Mobile, yes, they can.

Colourlovers has the story (although they’re not really a news org) about how T-Mobile, as part of their trademark application, included the colour magenta. Now yes, it only pertains to the communication sector, but still, Magenta? Pretty vague, at least throw in some formula to try and dupe the courts.

Of course this reminds us of Tiffany who have taken it one step further registered their famous blue-green robin egg colour as a trademark. They also worked with Pantone to ensure that no one else is allowed to use PMS 1837 (named for the year of Tiffany & Co.’s founding)

Here’s a New York Times article from a few years back about this very topic — trademark colours, logos, branding, etc.

I suppose the next natural step for companies is to hold trademarks on their spokespeople. Do you think T-Mobile owns the ‘intellectual property’ rights to Catherine Zeta-Jones? Talk about Brand Value.

I wonder who will claim ownership of the colour black?

Trademark control is, well, out of control. Next thing you know, companies are going to trademark fonts, gradients, shapes, etc.

That is just too funny! Even when I worked at AT&T at the height of their ‘power’ the company didn’t claim to own that hideous process blue.

I agree with you, Prescott. If T-Mobile created their own, custom magenta color, then I could understand trademarking it. When I worked for Household International and the logo changed for a rebranding initiative, a particular red was created called Household red. They didn’t trademark it, but did require that it be used in all materials. Of course, it was very close to PMS 201, so rather than pay for 4-color printing for every marketing material to get the accurate Household red, we just used 201 for less than 4-color jobs.

Anyway, I digress. The point is, unless T-Mobile came up with a custom magenta formula, I don’t think their trademark is worth the magenta paper it’s printed on.

T-Mobile’s registered trademark magenta is actually a very specific color. The German color standard is “RAL 4010″, I believe.
If people are interested in learning more, I just wrote an article about this here
